Non-habitual resident status

Portugal recognizes the non-regular resident status since the decree-law of 23rd September 2009. This new regime aims to achieve non-residents that establish a permanent residence in Portugal, as well as temporary residents. This regime allows non-regular residents to benefit from a special tax rate on some of their income in Portugal, as well as tax exemptions on foreign source incomes.

This status is granted to people who became Portuguese tax residents since January 1, 2009 and who haven’t received this status in the past five years. Therefore, the benefits of non-regular resident extends for a period of 10 consecutive years, after which those who benefited from it will be evaluated according to the traditional system of the Portuguese personal income tax.

How to acquire the non-habitual resident status

To apply for the non-regular resident status:

  • Having not been a (tax) resident in the last five years.
  • Register as a tax resident (personal income tax) in Portugal, on the local tax office and apply for the non-regular resident status.
  • To qualify for this application, you must have remained in Portugal for more than 183 consecutive or non-consecutive days. If you have remained for less time, you must prove your intent to stay by acquiring a home.

Buying a house

The acquisition of a property in Portugal, because it is subject to the payment of taxes, requires that you register with the Tax Authorities to obtain the corresponding taxpayer identification number, the place of residence for tax purposes is the place of usual residence.
To complete the purchase of your house, you must submit several documents that identify the property and confirm the legitimacy of the owner and the buyer:

  • Land Registry Certificate (or content certificate)
  • Title Certificate
  • Usage License
  • Energy Certificate

Taxes on acquisition - IMT

Taxes, such as legal fees, are exercised over the purchase price of the property, and its payment, as well as the land registry and notary costs are at the buyer’s expense. In Portugal there is no VAT incidence on a property purchase, but there is a tax named IMT (Municipal Tax on the Transfer of Property).

IMT rates

  • Property for permanent residence up to 6%
  • Property for other purpose housing (vacation or rental) up to 6%
  • Other municipal buildings, shops, offices, warehouses, parking and storage: 6.5%
  • Building plot: 6.5%
  • Rustic or agricultural plot: 5%
  • Tax haven resident (except individuals): 10%

Land Registry

After the buying and selling transaction, it is necessary to convert to permanent the temporary registration in the Land Registry Office (Conservatória do Registo Predial).

  • Title Certificate Cost - between € 150.00 and € 250.00
  • Property Deed Cost (notary act) - € 615.00

Stamp Duty

This tax has a broad range of incidence, covering all acts, contracts, documents, books, papers and other facts described in the General Table of the Stamp Duty.

  • Acquisition of real estate property - 0.8% of its value
  • Guarantees without term or term for a period not less than five years, as in the case of mortgages, the rate is - 0.6%.
  • Real estates over 1,000,000 euros asset value, 1% stamp duty tax of its value, or 7.5% in case of owner’s tax residence in a tax haven.

IMI (municipal property tax)

Following the property buying transaction, there is a yearly payment of the Municipal Tax (ITPU equivalent) to the local tax office. IMI focuses on Tax Asset Value (VPT) of rural and urban properties located in the county, and generally the properties are evaluated under the purchased price. The applicable rate varies, depending on the county in which the property is located. Please find below the applicable fees in some municipalities, for instance:

Taxes on rental income

If you rent your property you will be subject to a tax payment on income earned, which has a fixed percentage of 28% of the annual income (25% if the beneficiary is a legal person). The maintenance and conservation costs (which include co-ownership costs) can be deducted.

Taxes on surplus value

When reselling your property, you must pay a tax on surplus value generated (the difference between the sale price and the buying price at the time of acquisition), which has a 25% fixed rate.

FAQ

What is necessary to benefit the Non-Regular Residents tax regime?

1. Only those citizens eligible to become residents in Portugal may benefit from this tax regime.
When coming to Portugal and until meeting those conditions, they must first apply for the registration as a non-resident at any tax office and appoint a tax representative in Portugal (applicable to third-country citizens).

Citizens from the European Union and the European Economic Area in this situation don’t need to appoint such a representative. However, when applying for non-resident registration, these citizens must provide the address of the other country of the European Union or the European Economic Area and submit documentary proof.

2. You can apply for the registration as non-regular resident as soon as you meet the necessary conditions (i.e. having remained in Portugal more than 183 consecutive or non-consecutive days, or having remained for a shorter time, you must have, as of December 31 of the year you apply for the registration, a home in such conditions that can lead to the assumption that is intended to be kept and occupied as your usual residence).

This request shall be presented by means of an application addressed to the Director of the Taxpayers’ Register Service (Department of Taxpayers’ Register Service, Av. João XXI, 76 – 6º Piso, 1049-065 Lisboa) (Diretor de Serviços de Registo de Contribuintes) (Direção de Serviços de Registo de Contribuinte), and must include a statement that the necessary conditions to be considered a resident in the Portuguese territory were not met in any of the five years prior to the year intended for the start of the taxation as a non-regular resident.

3. The right to be taxed as non-regular resident each year depends on whether or not the taxpayer can be considered a resident in the Portuguese territory that year (namely by attesting each year, that has remained in Portugal for more than 183 days, consecutive or non-consecutive, or when has remained for a shorter time, has, as of 31st December of that year, a home in such conditions that could lead to the assumption that it is intended to be kept and occupied as his/her usual residence.

Once considered resident in Portugal for tax purposes, must tax residence in the country of origin be canceled?

The need to cancel the tax residence in the country of origin depends on the country’s legislation. Taxpayers should contact their Tax Authorities to be informed about the necessary procedures to change residence to the Portuguese territory.

In order to obtain the Non-Regular Resident Status, how can I attest I have remained in the Portuguese territory for more than 183 days?

If you are a citizen of the European Union, your stay in the Portuguese territory for more than 183 days can be attested by means of a Registration Certificate for European Union Citizen issued by the City Council of your residence area.

Third-country citizens can attest their stay in the Portuguese territory by any means acceptable, namely by a purchase deed of a real estate intended for permanent and owner-occupied residence, a lease agreement for a permanent residence or an employment contract in the Portuguese territory.

The 0% tax measure on pensions applies to all European pensioners?

Yes, except for state employees. This new measure is aimed exclusively at pensioners who worked in the private sector and business in general.

Do I need to open a bank account in Portugal?

Yes, because you have to submit to your country of origin a bank account for future payment of your pension.

Retirement in Portugal

Portugal is a fantastic country to enjoy your retirement!
Firstly, the living cost is approximately 55% lower than in most other European countries.
In addition, there is no currency risk, it remains in the euro zone.
Tax treaties between European countries can avoid double taxation on income.
Therefore, since January 2013, the tax on foreign income (retirement pensions) for non-regular residents is 0%!

Of course, living in Portugal will increase their purchasing power, but it’s not the only advantage of this small country in southern Europe. Tax regime for non-habitual residents

No taxation of private pensions - 0% for a period of 10 years.
